1. Acceptance of Terms

By accessing and using Nepal Edu Marketplace platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These terms are governed by the laws of Nepal, including but not limited to the Electronic Transaction Act, 2063 (2008) and the Information Technology Act of Nepal.

2. Service Description

Nepal Edu Marketplace is an educational platform that connects students with tutors and educational institutions across Nepal. We provide:

• Access to online and offline tuition classes
• Course enrollment and management services
• Educational content and resources
• Communication between students and instructors

3. User Registration and Account

To access certain features of the platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Users must be at least 13 years old to create an account. For users under 18, parental or guardian consent is required.

4. Payment Terms

All payments are processed in Nepali Rupees (NPR) unless otherwise specified. By enrolling in paid courses:

• You agree to pay the course fees as displayed at the time of enrollment
• Payment methods accepted include eSewa, Khalti, bank transfer, and other approved payment gateways
• All fees are subject to applicable taxes as per Nepal tax laws
• Refunds are processed according to our refund policy (see Section 6)

5. Intellectual Property Rights

All content on Nepal Edu Marketplace, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, is protected under Nepal copyright law and international copyright treaties.

• Course materials remain the property of instructors or Nepal Edu Marketplace
• You may not reproduce, distribute, or create derivative works without permission
• Personal use for learning purposes is permitted
• Commercial use of any content is strictly prohibited

6. Refund and Cancellation Policy

General Policy

Refund eligibility depends on the type of course enrolled and the timing of the refund request.

All refunds, where applicable, will be processed only after deducting applicable payment gateway charges and any other administrative/service charges.

Non-Refundable Courses

The following courses are strictly non-refundable under any circumstances:

• Crash Courses
• Exam Preparation Courses
• Any other short-term intensive programs
• Any course explicitly marked as "Non-Refundable"
• Any other special or promotional course offerings

No refund will be granted once payment has been successfully made for the above-mentioned courses.

Refund Eligibility for Regular Courses

Refunds are applicable only to Regular Courses, subject to the following conditions:

Any course not classified as a Regular Course will not be eligible for refund unless explicitly stated in writing.

Payment Gateway Charges

All refunds are subject to deduction of non-recoverable payment gateway transaction charges (typically approximately 3%, but may vary depending on the payment provider).

These charges are imposed by third-party financial service providers and are not controlled by us.

Refund Processing Time

• Approved refunds will be processed within 7–14 business days.
• The actual crediting time depends on the banking system and payment provider.
• Refunds will be made only to the original payment method used.

7. User Conduct

You agree not to use the platform to:

• Violate any laws of Nepal or international laws
• Harass, abuse, or harm another person
• Share inappropriate, offensive, or illegal content
• Impersonate any person or entity
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the platform
• Engage in any form of academic dishonesty

8. Instructor Responsibilities

Instructors using the platform agree to:

• Provide accurate information about their qualifications and courses
• Deliver courses as described in the course details
• Maintain professional conduct with students
• Comply with all applicable education regulations in Nepal
• Respect intellectual property rights

9. Privacy and Data Protection

Your use of Nepal Edu Marketplace is also governed by our Privacy Policy. We collect and process personal data in accordance with Nepal's data protection laws and the Information Technology Act, 2063 (2008).

10. Limitation of Liability

Nepal Edu Marketplace is provided on an "as is" and "as available" basis. We do not guarantee:

• Uninterrupted or error-free service
• The accuracy, reliability, or quality of any content
• That defects will be corrected
• Specific educational outcomes or results

To the maximum extent permitted by Nepal law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

11. Dispute Resolution

Any disputes arising from these terms shall be governed by the laws of Nepal. Both parties agree to:

• First attempt to resolve disputes through negotiation
• If negotiation fails, submit to mediation as per Nepal's Mediation Act, 2068 (2011)
• If mediation fails, submit to the jurisdiction of courts in Kathmandu, Nepal

12. Termination

We reserve the right to suspend or terminate your account if:

• You violate these terms and conditions
• You engage in fraudulent or illegal activities
• Your account remains inactive for an extended period
• We discontinue the service (with reasonable notice)

Upon termination, your right to use the service will cease immediately.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Continued use of the platform after changes constitutes acceptance of the modified terms.

Users will be notified of significant changes via email or platform notification.
